Abstract
Questo studio esamina il ruolo giudiziario e l’evoluzione istituzionale dei boni homines nel Portogallo medievale, ricostruendone l’origine dalle tradizioni giuridiche visigote e la loro integrazione nei quadri normativi dei forais tra l’XI e il XIII secolo. Basandosi su diverse tipologie di fonti documentarie, mette in evidenza la partecipazione attiva dei boni homines nei procedimenti giudiziari, dalla funzione testimoniale ai momenti deliberativi e arbitrali. L’analisi colloca il loro status all’interno delle più ampie transizioni dai modelli giuridici romani a quelli germanici e da forme di governo municipale autonome a forme subordinate. Particolare attenzione è dedicata al loro rafforzamento semantico, al loro ruolo nel concilium e alla loro graduale marginalizzazione nel contesto della centralizzazione regia. In definitiva, lo studio sostiene che, sebbene i boni homines rappresentino un’istituzione durevole lungo tutto il Medioevo, le loro competenze furono progressivamente assorbite ed estinte nelle successive codificazioni legislative, offuscando la loro eredità come agenti civici della giustizia urbana medievale.
This study examines the judicial role and institutional evolution of the boni homines in medieval Portugal, tracing their emergence from Visigothic legal traditions and their integration into the normative frameworks of the forais between the eleventh and thirteenth centuries. Drawing on various types of documentary sources it highlights the active participation of boni homines in judicial proceedings, from witness testimony to deliberation and arbitration. The analysis situates their status within broader transitions from Roman to Germanic legal models and from autonomous to subordinated municipal governance. Particular attention is given to their semantic reinforcement, their role in the concilium, and their gradual marginalization under royal centralization. Ultimately, the study argues that while the boni homines represent a durable institution across the Middle Ages, their competencies were extinguished in later legislative codifications, obscuring their legacy as civic agents of medieval urban justice.
